Background: A retail gasoline station and car wash, this site is bordered by Santa Rosa Creek. This facility successfully avoided cleanup and remediation for more than 10 years. Volatile organic compounds including benzene, toluene, and petroleum hydrocarbons (all known carcinogens and known to cause birth defects) entered the water table. The ground and surface water (which are a potential source of drinking water) have shown evidence of contamination since January of 1985.
RW Action and Results: RW sent a Prop 65 Notice Letter and a RCRA Notice Letter. The week after the Notice Letter was served Boyett had a dozen people remediating the site. This case was settled after a short round of litigation. In the settlement, Boyett agreed to accelerate its cleanup of the site, make available to RW, at its cost, any and all documents concerning site remediation, and allow RW the right to enter and inspect the property for the purposes of compliance with the settlement agreement.
